To my Kentucky Legislative Representative

Dear Legislative Representative,

My name is %first_name% %last_name% and I am emailing you to request that you vote in favor of passage of The Kentucky Planned Community Act (KYPCA) Legislation (Senate Bill ____). 260,000 Kentuckians residing in 175,000+ homes located in one of Kentucky’s 2,200+ Homeowner Associations (HOA) are not protected under any existing legislation that provides uniform standards for the development, operation, or management of their HOA organization.

The KYPCA is umbrella, default, legislation containing a number of important consumer protection elements necessary to protect homeowner’s single largest lifetime investment.

Consumer protections like:

o Adds disclosure to buyers that they are purchasing a Deed Restricted Home including disclosure of the HOA’s Financial Condition.
o Defines Insurance coverage to protect homeowners from HOA liability.
o Establishes Statewide Financial Management and Reporting Standards.
o Adds definitions and standards of Board of Directors’ Powers and Authority
o Enhances an HOA’s ability to enforce Deed Restrictions to maintain property values and neighborhood character.
o Includes guidelines to properly budget finances support the maintenance of association infrastructure like streets and storm water detention.
o Establishes limits on a Board’s ability to raise dues without homeowner approval.
o Provides a Statewide standard for HOA legal documents to create new HOA’s.
o Defines a process for the Revitalization of Defunct Associations.

Kentuckians throughout the Commonwealth need these consumer protections contained in the long overdue legislation.
